These Terms of Service ("Terms") govern your access to and use of the website located at dataairflow.com (the "Site"), operated by Data Airflow LLC ("Data Airflow," "we," "us," or "our"), a limited liability company organized under the laws of the State of Idaho with its principal place of business at 1750 W. Front Street, Ste 200, Boise, ID 83702, USA. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
By accessing the Site, you represent that you are at least 18 years old and have the legal capacity and authority to enter into these Terms. If you are using the Site on behalf of a company or other organization, you represent and warrant that you have authority to bind that entity to these Terms, and "you" refers to both you and that entity.
These Terms govern use of the Site only. Data Airflow's engineering, procurement, commissioning, design, consulting, modular, and other professional services are provided exclusively under separately executed written agreements — including master services agreements, statements of work, purchase orders, proposals, and non-disclosure agreements (collectively, "Service Agreements"). Nothing on the Site constitutes an offer to provide services, a binding commitment, or a modification of any Service Agreement. In the event of any conflict between these Terms and an executed Service Agreement, the Service Agreement controls with respect to its subject matter. No obligation of confidentiality, exclusivity, or engagement is created by your use of the Site or by any preliminary communication with us.
The content on the Site — including descriptions of services, technical explanations, case studies, articles, specifications, and performance figures — is provided for general informational purposes only. It does not constitute engineering, architectural, procurement, financial, legal, or other professional advice, and it is not a substitute for site-specific analysis performed under an executed Service Agreement by appropriately licensed professionals. No professional-client or engineer-client relationship is formed by your use of the Site or by any inquiry submitted through it. You should not act or rely on any Site content without seeking appropriate professional advice for your specific circumstances. Case studies and performance results describe specific projects under specific conditions and are not a representation or warranty that comparable results will be achieved for any other project.
Much of Data Airflow's work is performed under strict confidentiality obligations. Do not submit confidential, proprietary, or trade secret information — yours or any third party's — through the Site, including through contact forms or email links, unless and until a written non-disclosure agreement is in place between your organization and Data Airflow. Any information, ideas, suggestions, or materials you submit through the Site without a governing written agreement ("Unsolicited Submissions") will be treated as non-confidential and non-proprietary. By providing an Unsolicited Submission, you grant Data Airflow a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, and act upon it for any lawful purpose, and you represent that you have the right to submit it.
These Terms do not diminish, waive, or modify any confidentiality obligation contained in an executed non-disclosure agreement or Service Agreement. Information exchanged under such agreements remains governed exclusively by those agreements.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business and informational purposes. You may use the Site for lawful purposes only, and you agree not to use it in any way that violates applicable federal, state, local, or international laws or regulations.

The Data Airflow name, logo, and all related names, marks, and slogans are trademarks of Data Airflow LLC. Third-party names and marks appearing on the Site are the property of their respective owners. Nothing on the Site grants any license or right to use any trademark without the owner's prior written permission.
If you provide feedback, comments, or suggestions regarding the Site or our services, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback for any purpose without compensation, attribution, or obligation to you.
The Site may contain links to third-party websites and services, including our careers portal, analytics providers, and social media platforms. These links are provided for convenience only. TO THE FULLEST EXTENT PERMITTED BY LAW, DATA AIRFLOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SITE WILL BE SECURE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT CONTENT WILL BE CURRENT, COMPLETE, OR ACCURATE. THIS SECTION DOES NOT LIMIT ANY WARRANTY EXPRESSLY PROVIDED IN AN EXECUTED SERVICE AGREEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, DATA AIRFLOW LLC AND ITS MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SUCCESSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF DATA AIRFLOW ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. THIS SECTION APPLIES TO THE SITE ONLY AND DOES NOT LIMIT OR MODIFY ANY LIABILITY PROVISION IN AN EXECUTED SERVICE AGREEMENT.
You agree to indemnify, defend, and hold harmless Data Airflow LLC and its members, managers, officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the Site, your violation of these Terms, your violation of applicable law, or your infringement of any intellectual property or other right of any person or entity. We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.
The Site is controlled and operated from the United States. We make no representation that the Site or its content is appropriate or available for use in other locations, and access from territories where the content is illegal is prohibited. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. You agree to comply with all applicable U.S. export control and sanctions laws and regulations, and you represent that you are not located in, or a national or resident of, any country or on any list to which such access would be prohibited.
These Terms and any dispute arising out of or relating to the Site shall be governed by and construed in accordance with the laws of the State of Idaho and applicable U.S. federal law, without regard to conflict of law principles, and excluding the United Nations Convention on Contracts for the International Sale of Goods. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Ada County, Idaho, and you irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) EACH PARTY WAIVES ITS RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE; (B) ANY CLAIM MUST BE BROUGHT IN THE PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING; AND (C) ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE MUST BE FILED WITHIN ONE (1) YEAR AFTER IT ACCRUED, OR IT IS PERMANENTLY BARRED. Nothing in this section limits our right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason. Upon termination, the license granted to you under these Terms ends immediately. Provisions that by their nature should survive termination — including intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute resolution — survive.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "last updated" date, and material changes may be highlighted on the Site. Your continued use of the Site after any modifications constitutes your acceptance of the updated Terms. We may also modify, suspend, or discontinue any aspect of the Site at any time without notice or liability. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision; any waiver must be in writing and signed by an authorized representative of Data Airflow. You may not assign or transfer these Terms or any rights under them without our prior written consent; we may assign these Terms without restriction. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Data Airflow regarding use of the Site and supersede all prior understandings regarding that subject matter — provided that, as stated above, executed Service Agreements govern their own subject matter. No agency, partnership, joint venture, or employment relationship is created by these Terms or your use of the Site.
